the commercial activity of buying and selling on the website www.flex-arm.com is governed by the following terms of sale (pursuant to legislative decree no. 185/99 on distance contracts):
1 – PARTIES

2 – OBJECT OF THE SERVICE
The supplier, through this online store, provides the customer an electronic catalog of products. Additional and more detailed product information can be requested by e-mail at sales@tuboflex.it. The customer can view the entire catalog available on–line without any pre-registration and will be able to complete the purchase, after inserting the products in the cart, simply filling in the form.This contract shall be concluded exclusively through the online channel named "internet", at www.flex-arm.com, with conditions of sale established by the supplier, which shall remain in effect until changed by the same. any changes, corrections or updates will be posted in the appropriate sections on the services available on this site and will be effective from the date of publication. With the purchase, the customer unconditionally accepts the terms and conditions of sale.
3 – PRICES OF GOODS AND PURCHASE METHODS
all prices on the site www.flex-arm.com are including vat and do not include shipping costs, import duties, taxes and/or handling fees. For the purchase the supplier issues a fiscal receipt; vat owner can require the invoice when ordering, filling in the form with complete data company, including vat code. The purchase contract is concluded only by correctly filling in the order form published on the website and expressing the consent to the purchase by adhering online. The customer will take care to check the total amount including vat and transport costs before purchasing. Before confirming the order, the customer can choose between the following payment methods:
• paypal service: if you have a credit card visa, visa electron, mastercard, maestro or postepay you can pay conveniently via internet through paypal, which ensures maximum safety and protection of privacy. The procedure is very simple: after you place your order on our website by selecting "credit card" as form of payment, you will be redirected to the secure server of paypal, where you will be prompted to enter your personal information and data relating to your credit card. this information will not be sent to aws, but will be handled directly by paypal. after this procedure the customer, which will then become a registered member of paypal, will immediately receive a notification of payment to the email address indicated in the order confirmation. the same notification is automatically sent also to aws.
• bank transfer: if you choose this method of payment aws will receive your order confirmation with your e-mail address, and will respond by indicating data bank for payment. the order will be processed after receipt of the amount due. NB: it is no longer necessary to go to a bank to make a transfer, it is possible to do it online using the services of home banking that many banks make available to their customers. In case of change of prices, those in the cart will not be changed. the remaining prices could however be subject to change without notice, according to current prices or possible promotions in progress.
4 – WITHDRAWAL RIGHT
Pursuant to legislative decree 185/99 the costumer may exercise the right to withdraw from the contract without penalty and without specifying the reason within 10 working days from the day you receive the products. To exercise the right of withdrawal, the customer must give notice of its decision by e-mail, specifying the data bank on which the reimbursement has to be done, after which he must return to aws products undamaged, in the original packaging and accompanied by a fiscal document (shipping documents or invoice if already received). The costumer will bear the costs for return shipping, which will be under its responsibility. Goods returned with requests for payment on delivery will not be accepted.
Aws will reimburse the paid amount, excluding shipping costs, as soon as the products are received. If the ordered products are not withdrawn and return to sender, the customer will still be required to pay postage costs incurred by Aws for the shipment and returning of the package.
5 – BUYER’S OBLIGATIONS
Once the on-line order is processed, the costumer should/must print and retain these terms and conditions, in addition to the order confirmation sent to the email address indicated in the order. it is strictly forbidden to enter false and/or invented data in the registration procedure necessary for carrying out the present contract and the relative further communications; personal data and e-mail address must be the only real personal data and not of third people.
6 – AUTHORISATION
By compiling the specific space on the website, the customer authorizes aws to use their credit card or other card issued in replacement thereof, and to debit on their bank account, on behalf of aws, the total cost of the purchase made online. The procedure is carried out through protected connection, directly linked to the bank holder and manager of online payment service, to which aws cannot access.
7 – DISPATCHING AND DELIVERY TIMES
Goods will be send by currier and shipping costs will be calculated at the time of confirmation, according to the destination, which must be properly chosen from those proposed; the total amount to be paid will be included in the invoice. Aws will then ship the goods carriage free. The website shows the estimated time for delivery; however, the customer acknowledges the remote possibility that some items may no longer be available at the time. In this case, after the confirmation of the order by e-mail, Aws will inform the customer by telephone and/or through a new e-mail and the order received shall, if so requested, be canceled.
In no case, any responsibility can be attributed to aws for the lengthening of delivery times specified. Delivery is available from monday to friday.
Shippings are not carried out during closing periods for holiday: from 25/07 to 26/08 - from 20/12 to 6/01
8 – LIABILITY FOR TRANSACTIONS AND SHIPPING
Aws disclaims any responsibility in case of inefficiency due to force majeure, events that may prevent the correct outcome of the contract, and will not be responsible for losses or damage of goods during transportation.
It is also not responsible for any abuse or fraudulent use of credit cards, checks and other means of payment, because at no time during the purchase procedure aws is able to recognize the number of buyer's credit card, which, operating over a secure connection, sends the data directly to the bank that manages the service.
9 – COMMUNICATIONS
Customer agrees that communications by aws occur by e-mail or, in case of extreme need, can be contacted by telephone by the staff.
10 – CONTRACT RESOLUTION AND TERMINATION CLAUSE
Aws has the right to terminate the contract by giving notice to the customer, with adequate and justified reasons. in this case, the customer shall only be entitled to a refund of the amount already paid.
The obligations assumed by the customer (see section 4) as well as the guarantee of successful completion of payment the customer makes, are essential, so that by express agreement, the failure by the customer to only one of these obligations will lead to termination of the contract without the need for judicial decision, save the right for aws to sue for damages.
11 – APPLICABLE LAW
The sales contract between the customer and aws is concluded in italy and governed by italian law. for the resolution of civil and penal controversies arising from the completion of this contract of sale at a distance, if the customer is a consumer, the territorial competence is that of the reference hole of his town of residence, in all other cases the local jurisdiction is exclusively that of the court of milan.
